Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Tokzee App (website at www.tokzee.live and our mobile applications) operated by VoicePe Technologies Private Limited ("Company", "we", "our", "us"). "You" or "your" refers to any user of the Tokzee App. These Terms incorporate by reference the specific Terms of Use applicable to Superhosts (available via in-app link) and must be read together with our Privacy Policy and Community Guidelines (collectively, "Platform Policies"). If you do not agree, please do not use the Tokzee App.
1. Acceptance of Terms
By accessing and using Tokzee, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our service.
2. Use of Service
Tokzee provides a platform for connecting users with verified experts for anonymous audio and video conversations. You must be at least 18 years old to use this service.
3. About the App
Tokzee App enables users to connect through one-on-one audio and video calls, initiated at users' discretion. Calls use Coins (virtual credits) purchasable in-app, and users may send virtual gifts (together, the "Services"). Certain behavior is strictly prohibited—see our Community Guidelines. By starting a transaction to use any Service, you enter a legally binding agreement with us for provision of that Service.
The Tokzee App is operated by VoicePe Technologies Private Limited, registered in India, office at 79 Panchwati, Behind Kids Kingdom School, Udaipur City, Girwa, Udaipur, Rajasthan 313001, India. Ensure you are permitted to use the Tokzee App under the laws of your jurisdiction.
4. Changes to the Terms
We may update the Platform Policies from time to time, including modifying, disabling, or removing features or services, temporarily or permanently. Where a change is material or affects your rights/obligations, we will take reasonable steps to notify you (e.g., updating this page or an in-app notice). If consent is required by law, we will seek it. Your continued use after updates take effect constitutes acceptance. Please review this page periodically.
5. Eligibility
You may use the Tokzee App only if you can form a legally binding agreement with us, are at least 18 years old, and are legally permitted to use the Services under applicable law.
6. Signing Up
To create an account, you must provide your username, mobile number, gender, and age. You agree to provide accurate, complete, and up-to-date information and are responsible for all activity through your account. Keep your credentials secure and notify us immediately of any unauthorised use.
You consent to receive communications on your registered mobile number (including if listed under DND/NCPR) and authorise us to share/disclose information to third-party service providers, affiliates, group companies and their authorised agents. Your use of the App signifies agreement with our Privacy Policy.
Subject to the Platform Policies, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the App and Services. App software may update automatically.
7. Account Suspension, Blocking, or Deletion
We may suspend, block, or delete your account if:
- It remains inactive for a period defined in our internal policies
- Directed by a competent authority under applicable law
- You violate any Platform Policies
Where possible, we will notify you beforehand; however, we may act without notice in cases involving legal obligations, serious violations, or risk to user safety or the platform.
8. User Obligations
Use the Tokzee App Lawfully and Respectfully
- Do not violate any laws (in India or elsewhere)
- Do not bypass technical protections or interfere with our systems (e.g., spamming, malicious code, scraping, unauthorised access, automated tools/scripts)
- Do not interfere with other users' experience
- Do not infringe intellectual property rights (ours or others')
Provide Accurate Information
Use your correct phone number and gender. Do not provide false information or impersonate others.
Keep Your Account Secure
- You are responsible for all activity on your account
- Do not share credentials, phone number, OTPs, or payment details
- Do not allow others to access or use your account
- If asked for sensitive information by a user, report them immediately
Follow our Community Guidelines
All interactions must comply with the Community Guidelines. Violations may result in suspension or permanent termination. To appeal, contact support@tokzee.live or grievance.officer@tokzee.live.
Do Not Share Prohibited Content
Do not share illegal, harmful, obscene, discriminatory, hateful, or violent content, or content harmful to minors. We may remove content and take appropriate action against your account.
9. Legal Disclosures and Our Liability
We may share information with authorities if required by law or if we believe it is reasonably necessary to respond to valid legal requests, protect rights/safety/property, or prevent fraud/misuse/security risks. While we work to keep Tokzee safe, we are not responsible for other users' actions on or off the App.
You retain ownership of your content. Do not violate others' IP rights. We retain ownership of IP in Tokzee content, design, features, trademarks, and software. Unauthorised use may result in account action.
10. Deleting Your Account and Data Retention
You may delete your account at any time. We may retain some data for a limited period to allow reactivation and as described in our Privacy Policy.
11. Our Responsibility and Limitations
Tokzee provides a platform for one-on-one audio/video calls. We act as an intermediary and do not create, control, or endorse user content or interactions. We may assign/transfer our rights and obligations under these Terms to third parties (e.g., merger, acquisition, sale of assets, or by operation of law). You may not assign your rights or obligations without our prior written consent.
12. Third-Party Links and Tools
The App may contain links or features (e.g., AI tools, social sharing) operated by third parties. We do not control these sites/services and are not responsible for their content, accuracy, or practices. Your use is at your discretion and governed by their terms and policies.
13. Intellectual Property
Use of the App must comply with copyright, trademark, patent, and other IP laws. We own all IP in the Tokzee App (including name, logo, software). Do not copy/use/distribute without permission. Third-party content/tools remain the property of their owners. We respect IP rights and expect users to do the same; infringement may result in action.
14. Payment Terms (Coins & Virtual Gifts)
Coins and virtual gifts are virtual items. When you purchase Coins or use them for gifts, you receive a limited, revocable, non-transferable licence to access those features within the App per these Terms.
- Purchases may be processed via payment gateways/app stores and are subject to their terms, fees, and currency conversion. We are not responsible for delays/failures/errors by providers.
- Prices are shown at point of sale and may include taxes. You are responsible for any taxes/fees charged by your provider. Once processed, Coins are credited to your account. All purchases are final and non-refundable to the maximum extent permitted by law.
- Coins can be used only on Tokzee, cannot be exchanged for cash/legal tender/credit/value, and are non-transferable. They cannot be traded on or off the App.
- Coins expire automatically if unused for six (6) months (182 days) from purchase and are forfeited without notice/refund/compensation. If your account is suspended/terminated for breach or law, Coins are forfeited without refund/compensation.
- Virtual gifts have no real-world value, cannot be converted back into Coins, and are non-refundable. We may replace a gift if corrupted or not functioning as intended at our discretion.
- We may change prices, expiry periods, or usage rules. Continued purchase/use after changes constitutes acceptance.
- We may restrict payment methods, revoke eligibility, cancel transactions, delay/block payments, or report suspected fraud or unlawful conduct to authorities.
- Coins, gifts, and related features are provided "as is where is" without warranties. Ensure your purchases/usage comply with your local laws.
15. Disclaimers and Limitation of Liability
The App and Services are provided "as is where is" without warranties (express or implied), including fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not guarantee the App will be uninterrupted or error-free. We do not monitor user behaviour or conduct background checks and are not responsible for other users' actions on or off the App.
To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of the App or Services (including direct, indirect, incidental, special, consequential, data/revenue/profit/reputation loss, or third-party claims). If liability is imposed by law, our total liability is limited to the amount you paid (if any) for Services on the App in the six (6) months before the event giving rise to the claim.
16. Expert Guidelines
All experts undergo verification and training. They are expected to provide empathetic, non-judgmental support. Experts are not licensed therapists or medical professionals.
17. Indemnity
You agree to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, agents, successors, and assigns from claims, demands, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the App/Services; your breach of these Terms; your violation of others' rights (IP, privacy, consumer protection); your violation of law or contracts; or your negligence or wilful misconduct. This survives termination. We may manage/settle claims at our sole discretion; you agree to cooperate as requested.
18. Dispute Resolution
These Terms are governed by the laws of India. Courts at Udaipur, Rajasthan, shall have exclusive jurisdiction over disputes arising from or in connection with these Terms, the Tokzee App, or the Services.
19. Termination and Remedies
These Terms are effective from acceptance and continue until terminated. We may suspend/terminate your account or restrict access, with or without notice, for violations, misuse, or unlawful/inappropriate conduct (on or off the App). This may include cancelling subscriptions without refund and reporting conduct to law enforcement. Termination includes removal of access and deletion of related information in accordance with our Privacy Policy. Provisions intended to survive (e.g., dispute resolution, disclaimers, limitations of liability, indemnity) will remain in effect.
